PRIVACY AND COOKIES POLICY

Pursuant to Article 13 of Regulation (EU) 2016/679 (hereinafter, “Regulation”), this is to inform you that Moodbe S.r.l. is the creator, owner and manager of Moodbe, both the app version for Users and Managers and the website version www.moodbe.it (hereafter also the “Site”), with the aim of placing customers and restaurant operators in contact to simplify the correspondence between personal eating habits and cuisine offered by the business activity. Through the Site, Users can find out more about Moodbe, understand the company’s core business and its interest in providing an innovative, immediate, simple and efficient match between supply and demand in the food and catering sector.

2. Type of data processed

Moodbe S.r.l. will process your personal data and contact details should your wish to send requests for information to the company or indicate your interest in possible employment and collaboration with Moodbe S.r.l..

The data collected by Moodbe S.r.l. includes your email, name, surname and address. The Owner does not collect or process data belonging to particular categories of Users through the website. Unless otherwise specified, all data requested by Moodbe is required. If you do not wish to disclose such data, Moodbe will not be able to provide you with any requested information or consider your interest in applying for collaboration activities or employment.

You are responsible for the truthfulness and traceability of the data entered and release the Owner from any liability related to the release of untruthful data and/or data not belonging to you.

3. Purposes and legal basis for the processing

The above-mentioned data is used by Moodbe S.r.l. to allow navigation, correct use and functionality of the Site in order to learn more about Moodbe’s business and to respond to your requests for information and/or collaboration.

Your data may also be transferred to other subjects to allow the Data Controller to comply with legal obligations or provide the service offered. Finally, Moodbe S.r.l. will retain personal data to comply with obligations under applicable law or at the official request of a public or judicial authority.

The legal basis for the above-mentioned processing lies in the performance of the Service requested following your access to the Site, even if only for the purposes of learning about the Owner’s activities. You may enter the usual required data to learn about any job openings at Moodbe S.r.l. and/or to send requests for collaboration or request simple information.

Only individuals over the age of 14 are permitted to submit requests of the type above. Upon entering your personal data, you assume responsibility for the accuracy of your statements and relieve the Owner of any liability arising from statements that are untrue or attributed to other people.

4. Processing methods

Moodbe S.r.l. shall carry out the processing in question, which relates to the Site and associated options, using computer and telematic methods, including automated methods, that guarantee the constant security and confidentiality of the data collected and processed.

Processing to ensure the functionality of the application and to comply with legal requirements may be carried out by Moodbe S.r.l. using manual, IT and telematic means without ever compromising the security and confidentiality of your data.

5. Data retention

We will retain your information for the minimum period necessary to fulfil the purposes described in this Policy. The criteria used to determine this retention period are: (i) the duration of the existing relationship with you; (ii) any legal or commercial obligations to which the company is subject; or (iii) any legal requirements or powers which entail a longer retention period (storage for the purposes of public interest, scientific or historical research, statistics).

Once the above terms have expired, your data will be destroyed, deleted or made anonymous consistent with the technical deletion and backup procedures. Nevertheless, at the end of the retention period, the data will be deleted. Therefore, upon expiry of this term, the right to access, erase, rectify or transfer your data may no longer be exercised.

6. Data processor

Data Processors are designated from time to time by the owner Moodbe S.r.l. pursuant to Art. 28 of Regulation (EU) 679/2016 with a specific act of appointment, and may therefore process and learn about the data you have provided. The Data Controller is ready to provide an updated list of the Data Processors appointed upon written request by the data subject.

7. Data recipients

In order to provide you with the best Moodbe app experience, the Owner may disclose your data to third parties in the following categories.

a) To fulfil legal obligations:

– parties that audit and certify financial statements;

– Authorities and supervisory and control bodies and in general, public or private entities with advertising

purposes;

b) To perform the service requested in the event the profile is activated:

– parties that manage debt collection or provide professional consulting services and

tax, legal and judicial assistance;

– digital and IT assistance.

8. Data transfer abroad

The data is processed at the Data Controller’s operational headquarters and any other place where the parties involved in processing are located. Moodbe S.r.l. shall not disclose your data to third parties or transfer them outside the European Union, but if it transfers your data abroad, it shall ensure that such operations are carried out in full compliance with current legislation on the protection of personal data and, in particular, on the basis of an adequacy decision under art. 45 of the Regulation or adequate guarantees under art. 46 of the Regulation. Nevertheless, you will be informed as soon as possible.

9. Exercising your rights as a data subject

Except for the limitations to exercising your rights as per articles 2-undecies and 2-duodecies of Legislative Decree 196/2003 and subsequent amendments (“Personal Data Protection Code”), as a data subject you may exercise the rights granted to you pursuant to and within the limits of Articles 15-21 of the Regulation, including the right to request access to your personal data from the controller, its rectification or erasure, or to restrict the processing of your data or object to its processing and portability.

You also have the right to revoke your consent to the processing of your data at any time without affecting the lawfulness of the processing based on the consent expressed before it was revoked.

Finally, you have the right to lodge a complaint with a competent supervisory authority in accordance with Art. 77, clause 1 of the Regulation, which in Italy is the “Guarantor for the protection of personal data”. Depending on the processing, you may exercise the rights above by sending written communication to the corresponding independent owner at the address listed in section 1.

Navigation data
